Terms and Conditions for Commercial Sales

These terms and conditions apply to the sale of commercial ironing equipment and services provided by CaterPick.com. By placing an order with us, you agree to be bound by these terms.

DEFINITIONS

- "Company" refers to CaterPick.com.
- "Customer" refers to the purchaser of the goods or services.
- "Goods" refers to commercial ironing equipment and related products supplied by the Company.
- "Contract" refers to the agreement between the Company and the Customer for the sale of Goods or provision of services.
- "Website" refers to www.caterpick.com and any related web pages.

1. ORDERS

1.1. All orders are subject to acceptance by the Company. The Company reserves the right to refuse any order for any reason.

1.2. Orders for bespoke or custom-built Goods cannot be cancelled or amended once production has commenced.

1.3. The Company requires full payment before dispatch of Goods. No credit terms are offered unless explicitly agreed in writing.

2. PRICE AND PAYMENT

2.1. Prices for Goods are as stated on the Website at the time of purchase or as quoted in writing. Prices are exclusive of VAT unless otherwise stated.

2.2. Payments must be made via bank transfer, debit/credit card, or any other payment method approved by the Company. Goods will not be dispatched until payment is received in full.

3. DELIVERY

3.1. Delivery times are estimates and may vary. The Company is not liable for delays caused by circumstances beyond its control.

3.2. The Customer must provide accurate delivery details and ensure someone is available to receive the delivery. After three failed delivery attempts, Goods will be returned to the Company, and the Customer will be responsible for any additional shipping costs incurred.

3.3. Delivery charges are non-refundable unless the Goods are faulty, as determined by the Company.

4. RETURNS AND CANCELLATIONS

4.1. Goods that are unused and in their original packaging may be returned within 14 days of delivery. A re-stocking fee of up to 25% of the product cost may be charged for such returns. Bespoke or custom-built Goods are non-returnable.

4.2. If the Goods are faulty, the Customer must notify the Company within 14 days of delivery. The Company will arrange for repair or replacement of the faulty Goods unless the fault is due to misuse, wear and tear, or lack of maintenance (including limescale damage).

4.3. Commercial Usage Returns: After 30 days of commercial use, no refunds or returns will be offered for any Goods, except where required by UK law, such as in the event of a manufacturing defect or other legal obligation. For faults arising after 30 days, repair or replacement may be offered at the Company's discretion.

4.4. Any electrical items returned after 14 days due to a fault will be repaired or replaced, provided the fault is not caused by improper use or maintenance. If repair or replacement is not possible, a refund may be issued at the Companys' discretion.

5. RISK AND TITLE

5.1. Risk in the Goods passes to the Customer upon delivery. The Company retains title to the Goods until full payment is received.

5.2. If payment is not made in full, the Company reserves the right to reclaim the Goods.

6. WARRANTY

6.1. The Company warrants that the Goods supplied will be free from defects in material and workmanship for a period of 12 months from the date of delivery, unless stated otherwise.

6.2. This warranty does not apply to defects caused by wear and tear, misuse, improper installation, or failure to follow product instructions.

6.3. Extended warranties may be available on certain products, subject to separate terms and conditions.

7. LIMITATION OF LIABILITY

7.1. Nothing in these terms shall exclude or limit the Companys' liability for death or personal injury caused by its negligence, or for any other liability that cannot be excluded under UK law.

7.2. The Company will not be liable for any indirect, incidental, or consequential losses arising from the sale of Goods or services, including loss of business, revenue, or profits.

7.3. In the event of late delivery or non-delivery, the Companys' liability will be limited to the refund of any sums paid by the Customer for the delayed or undelivered Goods.

8. DATA PROTECTION

8.1. The Company will process personal data in accordance with its Privacy Policy and in compliance with the UK General Data Protection Regulation (GDPR).

8.2. The Customer agrees to the Company processing personal data as necessary for the performance of the Contract.

9. INTELLECTUAL PROPERTY

9.1. All intellectual property rights in the Website, marketing materials, and Goods remain the property of the Company or its licensors.

9.2. The Customer is granted a limited license to use these materials only as necessary to benefit from the Goods or services purchased from the Company.

10. FORCE MAJEURE

10.1. The Company will not be liable for any failure or delay in performance of its obligations caused by events beyond its reasonable control, including, but not limited to, strikes, natural disasters, or transportation issues.

11. GOVERNING LAW AND JURISDICTION

11.1. These terms shall be governed by and construed in accordance with the laws of England and Wales.

11.2. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
